The agreement between you and Open Bear Organization for your use of Bear Wallet.
In plain language. Bear Wallet is free, and you may use it for your own personal finances. It is a record-keeping tool, not financial advice, and the numbers in it are only as good as what you enter. Your data is on your device, so backing it up is your responsibility. We provide the app as-is and our liability is limited. The full terms follow, and they are what actually binds.
1. Acceptance of these terms
By downloading, installing or using Bear Wallet (the "App"), you agree to these Terms & Conditions (the "Terms") and to our Privacy Policy, which forms part of them. If you do not agree, do not install the App, and uninstall it if you already have.
These Terms apply to Bear Wallet. Other Open Bear applications, when they exist, will have their own terms.
2. Who you are contracting with
The App is provided by Open Bear Organization ("Open Bear", "we", "us", "our") — an independent software project based in Vietnam, built and operated by a single developer. Open Bear is not an incorporated company; these Terms are an agreement between you and that developer trading as Open Bear Organization. 3. Eligibility
Bear Wallet contains nothing age-sensitive and is suitable for users of any age. However, because these Terms are a binding agreement, you must be at least 13 years old — or the minimum age of digital consent in your country, if that is higher — to accept them yourself. Younger users are welcome to use the App with the involvement of a parent or guardian, who accepts these Terms on their behalf.
4. Licence to use the app
Subject to these Terms, Open Bear grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use one copy of the App on devices you own or control, for your own personal, non-commercial purposes.
This licence does not permit you to:
- copy, distribute, sell, rent, lease, sublicense or otherwise commercialise the App;
- reverse engineer, decompile or disassemble the App, except to the extent that applicable law expressly permits it despite this restriction;
- remove, obscure or alter any proprietary notice, branding or attribution;
- use the App to build a competing product, or to extract its content or design for that purpose.
5. Not financial advice
Bear Wallet is a personal record-keeping and budgeting tool. It is not financial, investment, tax, accounting or legal advice, and nothing in the App constitutes a recommendation to take or refrain from any financial action.
The App does not connect to banks and performs no transactions. Every figure it shows is derived from what you enter, and every conclusion you draw from it is yours. For decisions that matter, consult a qualified professional. Currency exchange rates shown in the App are indicative, are supplied by a third party, may be delayed or inaccurate, and must not be relied on for actual currency dealing.
6. Your responsibilities
- Accuracy. You are responsible for the data you enter. The App cannot detect a mistyped amount or a miscategorised expense.
- Device security. Your records are only as protected as your phone. Keep a passcode or biometric lock enabled and keep your operating system updated.
- Lawful use. You will not use the App for any illegal, fraudulent or harmful purpose, or to record or facilitate activity that is unlawful where you are.
- Updates. Running a current version of the App and your OS is your responsibility; older versions may lose functionality or security fixes.
7. Your data, backup and loss
Bear Wallet stores your accounts, records, budgets and planned payments locally on your device. We neither collect nor hold this data — see the Privacy Policy for the detail.
The App provides no cloud backup or account recovery. If you lose, wipe, reset or replace your device, or uninstall the App, your records are gone and we cannot restore them — we hold no copy. Backing up your device is entirely your responsibility. Open Bear is not liable for any loss of data however caused.
8. Third-party services
The App contains no third-party SDKs. It communicates with exactly one server, which is operated by us and supplies currency exchange rates — see §7 of the Privacy Policy. The only third parties involved in the App are the app stores that distribute it, each governed by its own terms.
We do not warrant the accuracy, completeness, timeliness or availability of exchange rates. They are indicative figures derived from upstream market data, may be delayed, and must not be relied on for actual currency dealing.
9. Price, purchases and refunds
Bear Wallet is provided free of charge. All features described on this website are available at no cost, and the App contains no advertising.
Should Open Bear ever introduce an optional paid feature, subscription or donation, these Terms will be updated first to state exactly what is offered, at what price and on what billing terms, and no charge will be made without your explicit purchase. Any such transaction would be processed by Apple or Google, and billing, cancellation and refunds would be handled under Apple's or Google's store policies, not by us directly.
10. Intellectual property
The App, its source code, design, user interface, graphics, the names "Open Bear", "Open Bear Organization" and "Bear Wallet", and the associated logos are owned by Open Bear and protected by copyright, trade mark and other laws. These Terms grant you a licence to use the App, not any ownership of it.
The financial data you enter remains entirely yours. We claim no rights over it — and, since it never reaches us, we could not exercise any if we did.
If you send us feedback or a feature suggestion, you agree we may use it to improve our products without obligation, compensation or confidentiality. You are not required to send us feedback.
11. Acceptable use
You agree not to:
- interfere with, disrupt or attempt to gain unauthorised access to the App or any service it relies on;
- use automated means to overload or abuse the third-party services the App depends on;
- distribute modified versions of the App, or bundle it into another product;
- use the App in a way that infringes anyone's rights or breaches any applicable law.
12. Availability, updates and discontinuation
The App's core features work offline and will keep working on your device. Features that depend on the network — currency exchange rates in particular — may be unavailable, delayed or withdrawn.
We may update, modify or discontinue the App, or any of its features, at any time. We will make reasonable efforts to give notice of a discontinuation through the App or this website. Because your data is stored locally, discontinuing the App does not delete records already on your device, though an unmaintained app may eventually stop working after an operating-system update.
13. Disclaimer of warranties
To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the App will be uninterrupted, error-free or free of harmful components, that defects will be corrected, or that any calculation, rate or figure it displays is accurate or suitable for your purposes.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing in these Terms limits consumer rights that cannot be limited by law.
14. Limitation of liability
To the fullest extent permitted by law, Open Bear and the people who contribute to it will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, savings, goodwill, business opportunity or data, arising out of or relating to your use of, or inability to use, the App — including any financial decision made in reliance on it, any inaccurate entry or exchange rate, and any loss of records held on your device.
Because the App is supplied free of charge, our total aggregate liability to you for all claims relating to the App is limited to the amount you have actually paid us for it, which is nothing.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.
15. Indemnity
You agree to indemnify and hold Open Bear harmless from any claim, demand, loss or expense (including reasonable legal fees) arising from your misuse of the App, your breach of these Terms, or your violation of any law or third-party right.
16. Termination
You may terminate these Terms at any time by uninstalling the App. We may suspend or terminate your licence if you materially breach these Terms.
Sections 5, 7, 10 and 13 to 19 survive termination.
17. App Store and Google Play terms
Apple. These Terms are between you and Open Bear only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price paid (which for Bear Wallet is zero); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App. Apple is not responsible for addressing any claim by you or a third party relating to the App, including product liability, regulatory non-compliance or intellectual-property claims. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google. Your use of Google Play is additionally governed by the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.
18. Governing law and disputes
These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-law rules. The competent courts of Vietnam have jurisdiction over any dispute arising from them.
If you are a consumer resident in the European Union, the United Kingdom or another jurisdiction whose law gives you the benefit of mandatory local consumer protections, nothing in this section deprives you of those protections or of the right to bring proceedings in your local courts.
Before starting formal proceedings, please write to support@openbear.org. Most disputes about a free app are misunderstandings, and we would rather resolve them that way.
19. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and Open Bear regarding the App.
- Severability. If any provision is held unenforceable, the rest remains in force and the provision is modified to the minimum extent necessary.
- No waiver. Not enforcing a provision is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them in connection with a reorganisation or transfer of the App, on notice.
- Language. These Terms are published in English. Any translation is provided for convenience only; if a translation conflicts with the English text, the English version governs.
20. Changes to these terms
We may revise these Terms as the App or the law changes. The "last updated" date at the top reflects the current revision. For material changes we will give notice in the App or on this website before they take effect. Continuing to use the App after a change takes effect means you accept the revised Terms; if you do not, uninstall the App.
